STANDARD TERMS OF ENGAGEMENT

                         And,

                         You   (“Client”)

Overview

The Client contracts MLP to deliver [State package at agreed price] where the shoot will occur on [shoot date].

MLP will use their experience and professional care to deliver you an awesome experience.  This includes but is not limited to preparing the Client for the shoot, arranging the brief for the shoot (including, but not limited to, concept and logistics of the shoot, scoping location time and details, where appropriate, organising props and wardrobe), the shoot itself which includes direction and posing where necessary as well as post production and open communication with the Client.

A deposit of $100 is required to confirm the booking and payment in full is due by the shoot date.  Any extras booked during the shoot or extra photos ordered post-shoot will not be delivered until payment is made in full.

What to expect

Pre-shoot                  

A conversation either by email or over the phone initially will kick off the shoot engagement. In this conversation we’re talking about your wishes and desires to develop a working brief for the shoot.  We’ll also discuss things like what you want as an outcome, your outfit(s), hair and makeup and also any inspirations that you have for the shoot.  Sometimes it’s useful if you have images you’ve seen that you like to share that with MLP.

We’ll also discuss any feelings, fears or hesitations you might have about the shoot and any other details that contribute to the process of completing the shoot.

On the day

We meet at the agreed time and location.  If it’s been organised we’ll get hair and makeup done then we’ll get into the shoot.  The idea is to have some fun; we’ll do some warm up shots to get into the swing of things and then off we go.  The biggest thing you as the Client can do is bring a positive, can-do energy.  We might have some music and snacks and MLP will guide you through the brief and make suggestions for poses.  MLP can guarantee you will get out of the shoot what you bring to the shoot, so bring your smile and positive vibes.

After the shoot

This is where MLP’s next stage of work begins.  Post product and editing of your images for you to review will take approximately 2 weeks post shoot.  These will be uploaded to an online gallery hosted on a private server for your review and selection.  If you order any prints and physical products, MLP will give you a more accurate estimate of timeframes but allow 2-4 weeks post the review session for delivery.

 

Postpone/Cancel

In the event of inappropriate weather, equipment failure, Covid-19 or other so-called “Acts of God” causing the shoot to be unable to proceed then a new date will be re-scheduled with the mutual agreement of the parties.

Refund policy

Once the booking is confirmed and a deposit paid the process of organising your shoot will be underway.  For this reason, there is a no refund policy should the shoot be cancelled by the Client.  Similarly, failure to attend the shoot on the agreed day and time will mean the Client forfeits their booking fee in full.

Due to the nature of digital imagery, once an image is supplied to the Client it may not under circumstance be returned for refund.  It is important therefore that the Client carefully chooses the images they wish to make up the package from the online gallery during the review session as there is no change of mind or ‘do not like’ return process.

MLP guarantees the quality of workmanship and products/print/canvas (other materials used in the product) so that the product purchase meets a commercially acceptable standard.

While the standard deposit of $100 is non-refundable, it is transferrable to another shoot date – by agreement between the parties

Licence

For the images purchased by the client during the review session, MLP grants the Client a personal use licence.  The images can be used repeatedly for personal use which means non-commercial use of the media for display on personal websites and computers or making image prints or video copies for personal use.  The media may not be used in any way whatsoever in which you charge money, collect fees or receive any form of remuneration.

For all other Terms and Conditions not specified on this page the NZ IPP Standard Terms of Engagement shall apply.
